Before purchasing a Memento Code on our website www.giftmemento.ae, please read these terms and conditions carefully. These terms explain how our services work, including how experiences are booked and redeemed. By placing an order, you agree to these terms. If you have questions, contact us at info@giftmemento.ae. Where applicable, service provider terms will also apply to the experience delivery.

1. Eligibility to Use the Services

By using the website and services, you confirm that you are of legal age in your jurisdiction and have the legal capacity to enter into contracts. If you are purchasing a gift for a minor, you confirm that you are the parent or legal guardian or have their consent.

2. Account Creation and Management

Certain features of the website may require you to create an account. You are responsible for safeguarding your account credentials and ensuring the information provided is accurate and up-to-date. Memento is not liable for unauthorized access to your account resulting from your negligence.

3. How Memento Works

When a customer purchases an experience, a Memento Code is generated and sent to the recipient digitally or inside a premium physical gift box. To redeem it, the recipient must activate their Memento Code at https://giftmemento.ae/pages/activate-memento and submit a booking request to the Memento Concierge.

All booking requests must be submitted at least 14 days before the desired date. The Concierge will coordinate with the selected experience provider and confirm availability. The recipient will then receive the final booking details from Memento.

Memento does not directly provide the experiences, but collaborates with third-party experience providers who hold the appropriate permits and licenses to operate in the UAE.

The list of available experiences and experience providers within each collection may change at any time without prior notice. If a recipient's preferred experience is no longer available, Memento Concierge will assist in booking an alternative experience of similar value.

4. Non-Exchangeable Memento Codes

Each Memento Code is tied to a specific experience category and selection of providers. Codes cannot be exchanged for other experiences or used with providers outside the assigned category. Please review the experience description carefully before purchasing.

5. Refund Policy

Refunds are only provided if Memento is unable to fulfill the experience due to unavailability or discontinuation of the provider. In such cases, the buyer may request a refund of the amount paid, excluding packaging and delivery charges.

If the experience selected by the recipient is no longer available at the time of booking, Memento will help the recipient choose another experience of similar value from the same collection. Refunds are not applicable in these cases.

Memento Codes are non-refundable in all other cases, including customer cancellations.

6. Code Validity

Each Memento Code is valid for a period of six (6) months from the date of purchase. Expired codes cannot be redeemed, extended, or reissued. Codes are valid for single use only and may not be reused or exchanged.

7. Booking and Redemption

To redeem an experience, recipients must activate their Memento Code and request a booking with Memento Concierge at least 14 days in advance. Booking is subject to availability and provider schedules. Once confirmed, the provider's terms and policies apply.

8. Recipient Responsibilities

Recipients are responsible for ensuring they meet eligibility requirements for their chosen experience, including age, health, or physical condition. They must comply with any safety instructions provided by the experience provider and use the services respectfully and lawfully.

9. Cancellation and Rescheduling

If a recipient wishes to cancel or reschedule, they must notify Memento at least 72 hours before the scheduled time. However, Memento does not offer reimbursements for cancellations, even when made with advance notice. Rebooking may be arranged at the discretion of the provider and is subject to availability.

If a provider cancels due to external factors (e.g., bad weather), Memento will assist in rescheduling. Memento is not responsible for additional costs such as transport or accommodation.

10. Issues and Complaints

If any issue arises during the experience, the recipient must inform the provider immediately. If unresolved, the recipient should contact Memento within 7 days by emailing info@giftmemento.ae with their Memento Code and a detailed description. Memento will review the case and respond within 30 days.

11. Intellectual Property

All content on www.giftmemento.ae, including images, text, and branding, is the property of Memento LLC or its partners. Unauthorized use, copying, or reproduction is strictly prohibited.

12. Termination

Memento reserves the right to suspend or terminate a user’s access to the site or services at its discretion for violations of these terms.

13. Limitation of Liability

Memento is not liable for direct or indirect damages related to the use of its services or the performance of third-party experience providers. Memento’s maximum liability is limited to the amount paid for the Memento Code.

14. Changes to Terms

These terms may be updated at any time without notice. The latest version will always be available at www.giftmemento.ae. Continued use of the website constitutes acceptance of the updated terms.

15. Governing Law and Dispute Resolution

These terms are governed by the laws of the United Arab Emirates. Any disputes will be resolved through negotiation or arbitration under UAE law.
